These Terms of Use ("Terms") govern your access to and use of fishingforfreedomnh.com (the "Website"), operated by Fishing for Freedom NH/ME ("Fishing for Freedom," "we," "us," or "our"), a registered 501(c)(3) nonprofit organization. By using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. Eligibility

You may use the Website only if you are at least 18 years old, or if you are using it with the involvement of a parent or guardian. The Website is intended for users located in the United States.

2. Informational Purpose Only

The Website provides general information about our nonprofit mission and free fishing outings for veterans and first responders. Website content is not legal, medical, mental health, or other professional advice.

Trip dates, locations, species, and details shown on the Website are subject to change due to weather, fishing regulations, vessel availability, and other circumstances. Check our Facebook page or contact us for the latest information.

3. No Reservation, Contract, or Guarantee

Website content is an invitation to contact us, not a binding offer. Your use of the Website or submission of the contact form does not:

  • reserve a seat on any trip or event;
  • confirm your eligibility to participate;
  • create a contract, agency, or other relationship; or
  • guarantee that any trip or event will take place as described.

Participation is confirmed only directly by Fishing for Freedom and may require separate registration, eligibility verification, and a signed participant waiver.

4. Outdoor Activity Risks

Fishing trips, boat outings, and ice fishing events involve inherent risks, including weather, cold water, ice conditions, motion sickness, and injury. Participants are responsible for following all safety instructions, captain and organizer directions, and applicable fishing and boating regulations. Any participation is governed by the waiver and rules provided for that event.

5. Contact Form

When submitting the contact form, you agree to provide current, accurate, and truthful information. Form submissions are not guaranteed to be received or reviewed within any particular time. If your request is time-sensitive, contact us directly at jim@saccocciaelectric.com or (603) 403-0824.

Do not submit Social Security numbers, medical records, service records, payment-card data, or other highly sensitive information through the Website form. Submitting a form authorizes us to respond using the contact information you provide. It does not provide consent for recurring automated marketing calls or text messages where separate consent is required by law.

6. Emergencies and Crisis Support

The Website and its form are not monitored as an emergency service. In an emergency, call 911. If you are a veteran in crisis or concerned about one, call 988 and press 1 to reach the Veterans Crisis Line.

7. Permitted Use

We grant you a limited, revocable, nonexclusive, nontransferable license to use the Website for lawful, personal, and informational purposes. You may not:

  • violate any applicable law, regulation, or third-party right;
  • use the Website fraudulently, deceptively, or for an unlawful purpose;
  • impersonate another person or misrepresent your identity, service, or affiliation;
  • submit false, misleading, harassing, or unlawful material;
  • interfere with the Website's operation, security, or integrity; or
  • use bots, scrapers, or automated tools in a manner that burdens the Website.

8. Intellectual Property and Photos

The Website and its content, including text, logos, and photographs, are owned by or licensed to Fishing for Freedom NH/ME and are protected by intellectual-property laws. Photos of events are shared to tell our story. If you appear in a photo and would like it removed, contact us and we will make reasonable efforts to remove it.

9. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Accessibility

11. Third-Party Services and Links

The Website links to third-party websites and services, including Facebook, Charity Navigator, NH Fish and Game, and other veteran resources. We do not control third parties and are not responsible for their content, availability, or practices. A link does not imply endorsement.

12. Website Availability and Changes

We may change, suspend, or discontinue any part of the Website at any time without notice. We do not guarantee uninterrupted access or freedom from errors.

13. Disclaimer of Warranties

To the maximum extent permitted by law, the Website and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, Fishing for Freedom NH/ME and its volunteers, officers, directors, and service providers will not be liable for any indirect, incidental, special, or consequential damages arising from or relating to the Website or these Terms. Our aggregate liability for all claims relating to the Website will not exceed one hundred U.S. dollars ($100). These limitations do not apply where prohibited by law.

15. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Fishing for Freedom NH/ME and its volunteers, officers, and directors from third-party claims arising from your unlawful use of the Website, material you submit, or your violation of these Terms.

16. Governing Law and Venue

These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles. Exclusive venue will lie in the state courts located in Strafford County, New Hampshire, or, where federal jurisdiction exists, the United States District Court for the District of New Hampshire.

17. Changes to These Terms

We may update these Terms by posting a revised version and changing the "Last Updated" date. Your continued use of the Website after changes take effect constitutes acceptance of the revised Terms.

18. General Terms

These Terms and the Privacy Policy are the entire agreement concerning use of the Website. If a provision is held invalid, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver.
